What should I do if I’ve been in a car accident?

Call the police and remain at the scene until help arrives. If you are seriously hurt, wait for emergency medical personnel to transport you to the hospital. But if you are not seriously hurt and are able to move around, there are some steps you can take.

Collect contact information for other drivers involved in the crash, as well as for any witnesses (including passengers). Exchange insurance information with the other drivers. But don’t talk about who may or may not have been at fault for the accident.  Stick to the facts of what happened and keep your comments brief.

Take photos of the crash scene. This includes photos of the damage to vehicles and other property, skid marks on the road, nearby traffic signs or signals and any visible injuries you have.

Do I need to see a doctor if I feel OK?

Yes. There are different reasons for this. First, you may be injured and not realize it. For example, you could have a concussion, or even a more serious traumatic brain injury. You could have internal injuries that require medical attention. A medical exam can detect any problems before they get worse. At the very least, an exam can make sure you are healthy and not in danger.

Second, getting a medical exam also protects your rights when you seek compensation. The insurance company will question why you didn’t get checked out by a doctor after the accident and will suggest it is evidence that you suffered no injuries. Getting a medical exam after your accident produces documentation that you were hurt.

What is my case worth?

How long will it take to resolve my case?

It depends on the details of your case. Sometimes, a negotiated settlement can be worked out with the insurance company in a matter of months. But in some cases, negotiations can go beyond that. If your case ends up in court, it can take one to two years before it is heard. And if your case involves long-term injuries, it can take even longer to resolve your case.
