Wrongful Death

Helping the family members of lost loved ones

Accidents caused by negligence happen all the time in Middle Georgia, and sadly, sometimes they are fatal. Families lose loved ones, and in many cases, providers. Macon wrongful death attorney Jon R. Hawk knows how devastating the loss of a loved one can be, and fights to hold negligent parties responsible.

A wrongful death case can arise out of any accident or incident in which one or more parties may be held liable for negligence, misconduct, recklessness or criminal conduct directly resulting in the death. Whether your loved one was lost after a motor vehicle accident, workplace accident, medical malpractice or other type of accident or incident, Jon R. Hawk, Sr., LLC can help you get justice.

Jon offers compassionate and experienced legal representation. Nothing can bring your loved one back. But he can fight to hold the negligent party accountable for what happened. And he can help recover compensation for your family as you all try to recover from your loss and rebuild your lives.

In Georgia, the surviving members of a decedent (usually the spouse) have up to two years following the death to file a wrongful death lawsuit, but if the suit is filed on behalf of the estate, special circumstances may extend the timeline as much as seven years. This is essentially a personal injury lawsuit filed on behalf of the person who died, and follows many of the same rules and procedures.

Experienced and compassionate representation

Every wrongful death case is actually two separate cases and addressed as such. First, Jon will work to establish liability directly leading to the death of your loved one. In cases involving a criminal act in which the perpetrator has been arrested, charged and found guilty, this is not difficult.

But in cases involving a car accident or a workplace accident caused by a defective product, proving intentional negligence or misconduct becomes murky. Jon’s experience, in-depth understanding of the law and of the evidence the courts expect to see help him build a strong case.

The second component of the case is often more emotional, as it requires determining the dollar value of your loved one's life. When the insurance company sits down to negotiate a settlement, the amount of its original proposal is often shockingly low, as it is based on annual salary and earnings remaining after normal living expenses have been deducted. But Jon never lets them forget that a human being was lost, one who meant so much to family members. He works to negotiate a claim that meets the needs of your family.
